Terms of Service

These Terms of Service ("Terms") govern your use of CropStack Weather ("the Service"), operated by CropStack ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

CropStack Weather is a pilot freeze-alert and forecast-intelligence tool for commercial farms. The Service ingests publicly available weather forecasts (NOAA / National Weather Service, Open-Meteo), evaluates them against the freeze thresholds you set for each crop block, and delivers forecast summaries and freeze alerts to you by SMS and email.

The Service is in active pilot. Features may change, break, or be removed. We do not guarantee uptime, specific message delivery times, or that any alert will reach you in time to prevent crop damage.

The Service provides decision-support information. It is not a substitute for your own professional judgment, on-site observation, agronomy consulting, or licensed meteorological services. You remain solely responsible for decisions about your crops, including whether and when to deploy protection measures such as irrigation, wind machines, or heaters.

Forecasts are inherently uncertain. Crop-damage thresholds vary by microclimate, plant condition, and many factors the Service cannot observe. You set the critical temperatures that trigger your alerts, and you are responsible for choosing and updating those values for your crops and conditions. Do not rely solely on the Service.

By enabling SMS notifications, you consent to receive automated text messages from CropStack Weather at the mobile number you provide. Message frequency varies with weather conditions; you may receive multiple messages on freeze nights and none on most other nights. Message and data rates may apply per your carrier.

Reply STOP to any message to opt out of all SMS. Reply HELP for help, or email tomas@cropstack.ai. You can also disable SMS from your account preferences. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding access to your account email; the Service uses magic-link sign-in, so anyone with access to your inbox can sign in.

You may not use the Service to send unsolicited messages, attempt to circumvent rate limits, scrape data, or interfere with the Service's operation.

The pilot is currently provided free of charge to invited growers. We may introduce paid pricing in the future; if we do, we will give existing pilot users reasonable advance notice and the option to discontinue use before charges begin.

The Service's software, design, and content are owned by CropStack. You retain ownership of the data you submit (farm descriptions, freeze-event logs). By submitting data, you grant us a non-exclusive license to use it to operate the Service and to compile aggregated, de-identified analytics that improve the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF FORECASTS OR ALERTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROPSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR CROP LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or where required by law. We may also discontinue the pilot at our discretion, with reasonable notice to active users.

We may revise these Terms as the Service evolves. Material changes will be communicated by email to active account holders. Your continued use of the Service after revisions take effect constitutes acceptance.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Florida, and you consent to that jurisdiction.
