Terms of Service

These Terms of Service ("Terms") govern your use of CropStack Weather ("the Service"), operated by CropStack ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

CropStack Weather is a pilot weather-alert and forecast tool for commercial farms. The Service uses publicly available weather forecasts (NOAA / National Weather Service, Open-Meteo), compares them with the settings you enter for each farm and crop block, and sends the messages described below to you and to the contacts you add, by text message (SMS and MMS), WhatsApp, and email.

Depending on the settings for each farm, block, and contact, the Service can send:

• Freeze alerts when a block's forecast air temperature or wet-bulb temperature reaches the levels you set. On a freeze night several can arrive as the forecast changes.
• Heat alerts: a heads-up, usually early in the morning, then reminders during work hours as often as hourly for each farm, on days the forecast heat index reaches the level you set on any of its blocks.
• Too-hot-to-spray alerts: a morning message on days forecast to be hotter than a block's spray temperature limit.
• Spray-window alerts when a spray you planned no longer looks suitable to apply.
• Irrigation recommendations, once a day for the farm or once a day for each block, depending on the contact's setting.
• A morning brief each day, an evening forecast email, and a weekly water report by email. A brief sent by text or WhatsApp can include a chart image.
• Replies to messages sent to our number, for example when a crew member texts to log an irrigation start or a low temperature.
• Test messages you send from a contact's page, and account emails with sign-in or password codes that you request.

Which of these a contact receives, and on which channels, is set on that contact. The evening forecast email and the weekly water report are the exception: they go to every contact whose email is turned on. Choosing more than one channel sends a separate message on each. If a WhatsApp message fails or is badly delayed, we may send it again as a text message to the same number. Messages are transactional farm alerts and summaries; we do not send marketing.

You can add other people, such as farm managers, crew leads, or consultants, as contacts who receive messages. When you add a contact and turn on text, WhatsApp, or email messages for them, you confirm that the phone number or email address belongs to that person, that they have agreed to receive those messages from CropStack Weather, and that you have told them how to stop. You must turn messages off or remove the contact promptly if they ask.

Email is turned on by default for a new contact with an email address. Text and WhatsApp messages stay off until you turn them on, and a single consent covers both. Contacts can opt out of text and WhatsApp messages themselves at any time, as described below. Only the contact can reverse an opt-out: you must not delete and re-add a contact, or add their number to another farm, to get around one.

The Service is in active pilot. Features may change, break, or be removed. We do not guarantee uptime, specific message delivery times, or that any alert will reach you in time to prevent crop damage.

The Service provides decision-support information. It is not a substitute for your own professional judgment, on-site observation, agronomy consulting, or licensed meteorological services. You remain solely responsible for decisions about your crops, including whether and when to deploy protection measures such as irrigation, wind machines, or heaters.

Forecasts are inherently uncertain. Crop-damage thresholds vary by microclimate, plant condition, and many factors the Service cannot observe. You set the temperatures and limits that trigger your alerts, and you are responsible for choosing and updating those values for your crops and conditions. Do not rely solely on the Service.

Heat alerts are reminders only. They do not replace your heat-illness prevention plan or your obligations to the people who work for you. Too-hot-to-spray and spray-window alerts are based on the forecast and the limits you set; always follow the product label and the judgment of whoever is applying it.

Some messages, including freeze alerts, spray-window alerts, irrigation recommendations, and the note in the evening forecast email, are written with the help of an AI model. The model works from our forecast figures and the settings you enter. The figures come from our rules, but the wording can contain mistakes. If a message seems wrong, check the figures in the app.

By turning on text or WhatsApp messages for a phone number, you consent, and confirm that the person using that number consents, to receive automated messages from CropStack Weather at that number, including text messages sent when a WhatsApp message cannot be delivered. Text messages come from +1 (689) 407-8425. How many arrive depends on the weather and on which messages are turned on: a daily brief and irrigation recommendations, if turned on, arrive every day, and a freeze night or a hot day can bring several more. Message and data rates may apply.

To stop text messages, reply STOP to any text from us; your carrier then blocks our texts to that number. To stop WhatsApp messages as well, and to stop our messages on every farm your number is listed on, send the single word UNSUBSCRIBE (in Spanish, CANCELAR) by text or WhatsApp. Do not reply STOP or PARAR on WhatsApp: there those words record that the irrigation water was turned off, and you stay subscribed. Opting out does not stop email.

To receive messages again, send the single word RESUME (in Spanish, REANUDAR) by text or WhatsApp. If you had sent STOP or UNSUBSCRIBE by text, also reply START by text so your carrier lets our texts through again.

For help, email support@cropstack.ai. Replying HELP (or AYUDA) lists the commands for logging irrigation and low temperatures by text. WhatsApp messages need a data connection on the phone and may arrive late where coverage is poor, so do not rely on WhatsApp alone for time-critical freeze alerts. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Para dejar de recibir también los de WhatsApp, envía la palabra CANCELAR por texto o por WhatsApp; no respondas STOP ni PARAR por WhatsApp. Para volver a recibirlos, envía REANUDAR (y, si enviaste STOP o UNSUBSCRIBE por mensaje de texto, responde también START). Emails go to contacts whose email is turned on. To stop them, the account holder can turn off email for that contact, or the contact can ask us at support@cropstack.ai. Opting out of text or WhatsApp messages does not stop email.

You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding both your password and access to your account email: the Service also signs you in with one-time codes sent to that address, and it is how a password is reset, so anyone with access to your inbox can sign in.

You may not use the Service to send unsolicited messages, attempt to circumvent rate limits, scrape data, or interfere with the Service's operation.

The pilot is currently provided free of charge to invited growers. We may introduce paid pricing in the future; if we do, we will give existing pilot users reasonable advance notice and the option to discontinue use before charges begin.

The Service's software, design, and content are owned by CropStack. You retain ownership of the data you submit (for example farm and block details, spray and irrigation plans, notes, and freeze-event logs). By submitting data, you grant us a non-exclusive license to use it to operate the Service and to compile aggregated, de-identified analytics that improve the Service. We do not sell your personal information.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF FORECASTS OR ALERTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROPSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR CROP LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or where required by law. We may also discontinue the pilot at our discretion, with reasonable notice to active users.

We may revise these Terms as the Service evolves. Material changes will be communicated by email to active account holders. Your continued use of the Service after revisions take effect constitutes acceptance.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Florida, and you consent to that jurisdiction.
